Terms of Service

These Terms of Service ("Terms") are an agreement between you and VictoryXR, Inc. ("VictoryXR", "we"), the operator of HoloTutor. They apply to the HoloTutor web app and any connected experiences (including VR clients) that share your HoloTutor account.

By accessing or using HoloTutor, including creating an account, signing in with a VictoryXR account, using an account provisioned for you by a school or organization, or redeeming an access code, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use HoloTutor.

If you use HoloTutor on behalf of a school, company, or other organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.

You are responsible for your account: keep your credentials confidential and let us know promptly if you suspect unauthorized use. Information you give us (like your name and email) must be accurate.

Some accounts are created and managed for you by an instructor or organization administrator. Those accounts may be subject to additional rules set by that organization, and the organization may see your learning activity; that is the point of those features. That includes, during a scenario, when you leave it for another tab or window and for how long.

You must be at least 13 years old to create a HoloTutor account yourself. Children under 13 may use HoloTutor only through an account created for them by a school or organization that has confirmed to us in writing that it is authorized to create accounts for its students and to provide any parental consent the law requires; in that case the organization agrees to these Terms on the child’s behalf, and the child is not asked to accept them.

HoloTutor is designed for use in educational settings. If you are a minor aged 13 to 17, you should use HoloTutor under the supervision of a parent, teacher, or organization.

Use HoloTutor lawfully and respectfully. You agree not to: harass or harm other users; upload or generate content that is unlawful, infringing, or intended to abuse others; misrepresent who you are or your affiliation.

You also agree not to abuse the service itself: no automated scraping, no attempts to extract model weights or training data, no probing or breaching security measures, no circumventing usage limits or metering, and no reselling access without our written agreement.

We can suspend or terminate accounts that violate these rules; see Suspension & termination below.

You keep ownership of the content you create in HoloTutor: lessons, prompts, activities, uploads, and responses. You are responsible for having the rights to anything you upload.

So we can operate the service, you grant VictoryXR a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content, solely to provide, maintain, and improve HoloTutor.

If you choose to publish content publicly, you additionally grant other HoloTutor users the right to view and use it within the product. Public publishing is subject to review by our staff before it becomes visible to others.

HoloTutor uses large language models and other AI services to generate lessons and respond to your prompts. AI-generated content can be inaccurate, incomplete, or outdated. Verify anything important against authoritative sources, especially for medical, legal, financial, or safety-critical topics.

AI output in HoloTutor is provided for educational purposes and is not professional advice.

Paid plans and seat licenses are purchased through our checkout (processed by Shopify) or through your organization. Prices, plan features, and usage allowances are described at purchase time and may change with notice; changes apply from your next billing period.

Refunds are handled case by case; contact us and we will make it right where the product failed you.

Licenses purchased by an organization are managed by that organization; it can assign, revoke, and reassign seats among its members.

Fair use of unlimited plans. Where a plan includes unlimited lesson creation, it is unlimited for classroom teaching. To keep the service fast for everyone, we may slow down generation, or switch to alternate AI models and voices, for unusually high volume, and we may limit repeated full re-generation of the same lesson (for example, re-recording its narration). Automated, bulk, or resold generation is not permitted. We will contact your organization before taking any step beyond slowing things down.

We may suspend or terminate your access if you materially violate these Terms, create risk or legal exposure for us or other users, or where required by law. Where reasonable, we will notify you and give you a chance to fix the problem.

You can stop using HoloTutor at any time and may request account deletion via the contact below. Sections that by their nature should survive termination (like ownership, disclaimers, and liability limits) survive.

HoloTutor is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate.

To the maximum extent permitted by law, VictoryXR will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to HoloTutor is limited to the greater of the amount you paid us in the twelve months before the claim arose or fifty US dollars.

Some jurisdictions do not allow certain warranty disclaimers or liability limits, so parts of this section may not apply to you.

These Terms are governed by the laws of the State of Iowa, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Iowa.

We may update these Terms as the product evolves. The "Last updated" date above reflects the current version. For material changes we will ask you to re-accept in the app (or notify you by email); continuing to use HoloTutor after a change takes effect means you accept the updated Terms.
